Welcome to MEOW Computer. The terms “we”, “us” and “our” refer to MEOW Computer.
MEOW Computer operates this store and website, including all related information, content, features, tools, products, and services (collectively, the “Services”) to provide you, the customer, with a curated shopping experience. MEOW Computer is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (“Terms”), together with any policies referenced herein, set out the rights and obligations that apply when you access or use our Services.
Please read these Terms carefully. They include important information regarding warranties, limitations of liability, and dispute handling.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Services.
SECTION 1 – ACCESS AND ACCOUNT
By agreeing to these Terms, you represent that you are at least the age of majority in your state or territory of residence, or that you have obtained consent from a parent or legal guardian.
You may be required to provide accurate, current, and complete information including billing, payment, and shipping details. You are responsible for maintaining the confidentiality of your account credentials and all activities conducted under your account.
Accounts may not be transferred, sold, or assigned.
SECTION 2 – OUR PRODUCTS
We make reasonable efforts to accurately display product information; however, actual product appearance may vary due to display or device settings.
Product descriptions, specifications, pricing, and availability are subject to change without notice. We reserve the right to discontinue or limit quantities of any product at any time.
SECTION 3 – ORDERS
Placing an order constitutes an offer to purchase. Orders are not accepted until payment is processed and an order confirmation is issued.
We reserve the right to refuse or cancel any order at our discretion.
Cancellations may not be possible once an order has been accepted. Returns and refunds are governed solely by our Refund Policy.
Unless otherwise agreed in writing, purchases are for personal or household use only.
SECTION 4 – PRICES AND BILLING
Prices are subject to change without notice. The price charged is the price displayed at the time of order confirmation.
Unless stated otherwise, prices exclude shipping, taxes, duties, or handling charges. You authorise us to charge all applicable fees to your nominated payment method.
SECTION 5 – SHIPPING AND DELIVERY
Delivery times are estimates only. We are not responsible for delays caused by carriers, customs, or events beyond our reasonable control.
Risk of loss and title pass to you once goods are handed to the carrier.
SECTION 6 – WARRANTIES & AUSTRALIAN CONSUMER LAW
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (“ACL”).
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
In addition to your statutory rights, MEOW Computer provides a limited hardware warranty as set out below. Nothing in these Terms excludes, restricts, or modifies any right or remedy available under the ACL that cannot lawfully be excluded.
6.1 Warranty Coverage
MEOW Computer provides a limited warranty covering defects in materials and workmanship under normal use for the warranty period specified on the invoice.
This warranty applies only to the original purchaser and only where the product is used in accordance with manufacturer specifications and MEOW Computer’s operating recommendations.
6.2 Exclusions from Warranty Coverage
The warranty does not cover damage, faults, or failures resulting from:
(a) Physical Damage
Including but not limited to drops, impacts, liquid ingress, foreign objects, pests, corrosion, oxidation, or burn marks.
(b) Unauthorised Modifications or Repairs
Including repairs or servicing not performed by MEOW Computer or an authorised service provider, overclocking, undervolting, BIOS or firmware modification, or use of non-approved components.
(c) Improper Maintenance
Including excessive dust buildup, blocked airflow, or overheating caused by lack of routine cleaning.
(d) Continued Operation with a Known Fault
Including use after signs of overheating, coolant leakage, power instability, or boot/POST errors.
(e) Improper Operating Environment
Including excessive humidity, dust, corrosive or salty environments, unstable power, poor ventilation, or extreme temperatures.
(f) Power & Voltage Issues
Including power surges, brownouts, lightning strikes, inadequate power supplies, or unstable electrical sources.
(g) Software-Related Issues
Including operating system corruption, malware, viruses, ransomware, third-party software conflicts, or data loss. Customers are responsible for maintaining backups.
(h) Custom Configurations
Including RAID arrays, virtual machines, or non-standard operating systems. Support may be offered on a paid basis only.
(i) Normal Wear and Tear
Including cosmetic damage and consumable components.
(j) Packaging & Transit Damage
Original packaging must be retained for returns. Damage caused by inadequate packaging is not covered.
6.3 Manufacturer Warranty
Individual components may be covered by the original manufacturer’s warranty, subject to their terms and conditions.
6.4 Service & Labour Charges
If a fault is found to be outside warranty coverage, repair or replacement may be offered on a paid basis. Labour charges are calculated based on time and complexity.
6.5 Acceptance of Warranty Terms
By purchasing from MEOW Computer, you acknowledge that you have read, understood, and agreed to these warranty terms.
SECTION 7 – INTELLECTUAL PROPERTY
All content on the Services is owned by MEOW Computer or its licensors and is protected by applicable intellectual property laws. No rights are granted except as expressly stated.
SECTION 8 – OPTIONAL TOOLS
Third-party tools are provided “as is” and “as available” without warranties. Use is at your own risk.
SECTION 9 – THIRD-PARTY LINKS
We are not responsible for third-party websites, content, or transactions. Access is at your own risk.
SECTION 10 – RELATIONSHIP WITH SHOPIFY
MEOW Computer is powered by Shopify. All transactions are between you and MEOW Computer. Shopify bears no responsibility for sales, products, or disputes.
SECTION 11 – PRIVACY POLICY
Your use of the Services is subject to our Privacy Policy and Shopify’s Privacy Policy.
SECTION 12 – FEEDBACK
You grant MEOW Computer a perpetual, royalty-free licence to use any feedback you submit.
SECTION 13 – ERRORS AND OMISSIONS
We reserve the right to correct errors and cancel orders arising from inaccuracies.
SECTION 14 – PROHIBITED USES
You must not misuse the Services, violate laws, infringe rights, distribute malware, or interfere with security or functionality.
SECTION 15 – DISCLAIMER OF WARRANTIES
Except as required by the ACL, the Services and products are provided “as is” and “as available” without additional warranties.
SECTION 16 – LIMITATION OF LIABILITY
To the fullest extent permitted by law, we are not liable for indirect or consequential losses. Where liability cannot be excluded under the ACL, liability is limited to repair, replacement, or cost of repair or replacement at our option.
SECTION 17 – INDEMNIFICATION
You agree to indemnify MEOW Computer against claims arising from your breach of these Terms or misuse of the Services.
SECTION 18 – SEVERABILITY
If any provision is unenforceable, the remainder remains in effect.
SECTION 19 – ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and MEOW Computer.
SECTION 20 – ASSIGNMENT
You may not assign these Terms without consent. We may assign freely.
SECTION 21 – GOVERNING LAW
These Terms are governed by the laws of New South Wales, Australia, and applicable Australian federal law.
SECTION 22 – HEADINGS
Headings are for convenience only.
SECTION 23 – CHANGES TO TERMS
We may update these Terms at any time. Continued use constitutes acceptance.
